Portfolio Framework

Three-Account Structure for German Investors
Analyze the user's situation against this three-tier hierarchy. Tier 1 must be funded before Tier 2; Tier 2 before Tier 3 (with the exception of employer-matched bAV, which is always priority regardless of tier).
Tier 1 — Liquidity (Emergency Fund)
Target: 3–6 months of net living expenses in instant-access savings (Tagesgeld).
Recommended providers (2026 rates ~3–3.5% p.a.):
- DKB Tagesgeld
- ING Extra-Konto
- Trade Republic (3.75% on cash balance, up to €50,000)
Action trigger: If Tier 1 is underfunded, redirect all new savings here before investing in Tier 3. Tier 2 employer contributions are exempt from this rule.
Tier 2 — Tax-Advantaged Retirement Accounts
Priority order within Tier 2:

bAV (Betriebliche Altersvorsorge) — always first if employer Zuschuss available
- Employer Zuschuss (≥15% mandatory by law since 2019 for new contracts, often higher) is effectively free additional compensation.
- 2026 tax-free contribution limit: €7,728/year (8% of Beitragsbemessungsgrenze West €96,600).
- Contributions reduce Bruttolohn → reduce GKV/RV/AV contributions AND Lohnsteuer. Net cost to employee is substantially less than gross contribution.
- Recommend: contribute at least enough to capture full employer Zuschuss.

Riester-Rente — for Angestellte with children or moderate income
- Suited for: employees with Kindergeldberechtigung (Kinderzulage €185/child; €300 for children born after 2008), or those in lower tax brackets where Günstigerprüfung does not apply.
- Max own contribution to receive full Zulage: 4% of prior-year Vorjahres-Bruttolohn minus received Zulagen.
- 2026 Grundzulage: €175/year. Assess: is Riester worthwhile without Kinderzulage? Only if marginal tax rate is high enough for the Sonderausgabenabzug to outweigh costs.

- Not recommended as primary vehicle for average earners — low liquidity, no inheritance, no early withdrawal.
Tier 3 — Taxable Investment Account (UCITS ETF Portfolio)
Fund after Tier 1 is complete and Tier 2 employer match is captured. This is the main wealth-building vehicle for most Angestellte.
Core ETF Building Blocks (EU-Domiciled UCITS Only)
All funds must be Ireland (IE) or Luxembourg (LU) domiciled. US-domiciled ETFs are not suitable for German retail investors — they lack the required PRIIPs KID and may trigger adverse US estate tax treatment.

Domicile rule: Always verify the ISIN prefix. IE = Ireland; LU = Luxembourg. Both are EU-domiciled and UCITS-compliant.
Accumulating vs distributing:
- Accumulating (thesaurierend): dividends reinvested automatically, no KapSt on distributions. Vorabpauschale (annual notional ETF tax) applies annually but is smaller than full distribution tax. Generally more tax-efficient for long-term growth investors.
- Distributing (ausschüttend): dividends paid out and subject to KapSt immediately. Useful if you want to live on dividends or actively consume the Sparerpauschbetrag (annual tax-free investment allowance) each year without waiting for Vorabpauschale.

German ETF Tax Mechanics
Vorabpauschale (annual notional ETF tax):
- Applies to accumulating ETFs each January.
- Calculated by broker: Rücknahmepreis on January 1 × Basiszins × 0.7 × (1 − Teilfreistellung (30% partial exemption on equity ETF gains) 30% for equity ETFs).
- Broker automatically debits the tax from the cash balance in the investment account in January.
- If insufficient cash, broker may sell fund units. Keep a small cash buffer in investment account to avoid forced sales.
- Offsets against Freistellungsauftrag first; remainder subject to Abgeltungsteuer (26.375%).
- In years with negative or zero Basiszins, Vorabpauschale = €0 (as in 2021–2022).
Teilfreistellung (30% partial exemption on equity ETF gains):
- 30% of equity ETF gains (dividends + realized capital gains + Vorabpauschale base) are exempt from Abgeltungsteuer.
- Effective tax rate on equity ETF gains: ~18.46% (instead of 26.375%).
- Bond ETFs: 0% Teilfreistellung (full rate applies).
- Mixed funds: 15% Teilfreistellung if equity allocation 25–50%; 30% if >50% equity.
Freistellungsauftrag (tax exemption order) strategy:
- Submit a Freistellungsauftrag at every broker where you hold taxable assets generating income.
- Total across all brokers must not exceed €1,000 (single) / €2,000 (married/Zusammenveranlagung).
- Allocate pro-rata to expected income volume per broker. Example: if 70% of investment account value is at Trade Republic, allocate ~€700 of the €1,000 Sparerpauschbetrag there.
- Freistellungsauftrag must be submitted before the tax is withheld — it does not retroactively reclaim withheld tax (that requires Anlage KAP in the Steuererklärung).
- Unused Sparerpauschbetrag cannot be carried forward — use it each year or it is lost.
Günstigerprüfung:
- If your marginal income tax rate is below 25%, apply for Günstigerprüfung in the Steuererklärung (Anlage KAP).
- The Finanzamt taxes capital income at the lower marginal rate instead of Abgeltungsteuer.
- Relevant for early career employees or those with low total income.
Verlustverrechnungstopf (loss pool):

Conservative (horizon < 5 years or low risk tolerance):
- 60% global equity ETF (SWDA or VWCE)
- 30% bond ETF (IEGA or IEAC)
- 10% instant-access savings (within investment account cash or external)
- Note: suitable for capital preservation near a major goal (house purchase, early retirement in 3–5 years)
Balanced (horizon 5–15 years):
- 80% global equity ETF (SWDA or VWCE)
- 15% emerging markets ETF (EIMI)
- 5% bond ETF
- Note: moderate growth with some drawdown protection; appropriate for most mid-career Angestellte
Growth (horizon 15+ years):
- 70% MSCI World ETF (SWDA or XDWD)
- 20% emerging markets ETF (EIMI)
- 10% Europe ETF (IMEU) or factor ETF (optional)
- Note: maximizes long-term equity return; requires ability to hold through 30–50% drawdowns without selling
100% Equity — only for very long horizons (20+ years) and genuinely high risk tolerance. Must be able to psychologically and financially hold through major bear markets.
Simplicity seekers (any profile): Replace the above splits with a single position in VWCE (Vanguard FTSE All-World Acc). Slightly higher TER (0.22%) but a single holding, single Sparplan, zero rebalancing needed. Appropriate for investors who value simplicity over marginal cost savings.
Rebalancing Rules
Primary method — new contributions (no tax event):
Direct new Sparplan contributions toward underweight asset classes. This rebalances the portfolio without triggering KapSt. Preferred for all situations.
Secondary method — threshold + loss harvesting:
Only sell to rebalance if:
- Allocation has drifted more than 10 percentage points from target, AND
- The position to be sold is in a loss (Verlustverrechnungstopf benefit), OR
- The position to be sold is within the Sparerpauschbetrag limit for the year (no tax due)
Annual rebalancing check: review allocation once per year (suggest: January after Vorabpauschale is settled, or birthday month).
Avoid: Selling winning positions in a taxable investment account purely to rebalance — this triggers KapSt and reduces compounding. Use the Verlustverrechnungstopf strategically.
