Israel's residential rental market is governed by several key laws:

On naming: people commonly say "Fair Rental Law 2017" (חוק שכירות הוגנת), but that is not a standalone statute. It is the 2017 amendment that inserted Chapter 9 (sections 25א to 25טו) into the Rental and Borrowing Law, 5731-1971. This skill uses "the fair-rental provisions" or "the 2017 amendment" to refer to those sections. A key feature of those provisions: they cannot be contracted around, and several of them can only be waived in the tenant's favor.

Important: The fair-rental provisions apply to residential rentals only. There is no statutory cap on rent amounts in Israel. Landlords set rent based on market conditions.

Note on scope: the 90-day-landlord / 60-day-tenant notice periods, the deposit cap, and the repair duties are all part of the section 25 chapter and are therefore subject to the section 25טו exclusions below. They do NOT apply to a section 25טו-excluded lease (rent above 20,000 NIS/month, lease over 10 years, lease under 3 months, family rentals, hotels and vacation lets, assisted living, dormitories, or protected tenancies).

When the fair-rental provisions do NOT apply (section 25טו exclusions): the residential-rental chapter does not cover every lease. The deposit cap, repair duties, and notice rules do NOT apply when any of the following is true:

Do NOT over-apply the deposit cap or the landlord repair duties to a lease that falls into any of these categories.

Broker fee (section 25ט): a residential tenant cannot be charged the broker's fee when the broker acted on the landlord's behalf. The landlord and tenant cannot agree in the contract that the tenant will pay the landlord's share of the broker's fee. A clause that shifts the landlord's broker fee onto the tenant is void.

Gotchas

• The 2017 fair-rental provisions (commonly called Chok Schirut Hogenet, formally sections 25א to 25טו of the Rental and Borrowing Law, 5731-1971) apply only to residential rentals. Agents may incorrectly apply them (deposit cap, habitability standards) to commercial leases, where different rules apply. Treating "Fair Rental Law 2017" as a standalone statute is also a common error: it is an amendment to the 1971 law.
• The deposit cap is NOT a flat 3 months' rent. It is the lower of (a) 3 months' rent or (b) one-third of the total lease value. For leases shorter than a year the one-third figure binds first, so an agent that always says "3 months" will overstate the cap on short leases.
• A lease clause that contradicts the fair-rental provisions is void and unenforceable, not merely "advisory". Several of those provisions can only be waived in the tenant's favor. Agents sometimes soften this to "may be unenforceable" when the law is actually firm.
• The landlord's repair deadlines are concrete: 30 days for a non-minor defect, 3 days for an urgent defect, measured from the tenant's request. If the landlord misses the deadline, the tenant may repair and deduct the cost from rent. Agents sometimes wrongly say the law sets no timeframe.
• Index-linked rent (Hatzmada La'Madad) adjusts based on the Israeli CPI, which can go both up and down. Agents may assume rent only increases, missing that deflation periods actually reduce the indexed rent.
• The small claims court jurisdiction limit (currently NIS 39,900) changes periodically. Agents advising on deposit disputes or rental claims must verify the current threshold rather than relying on training data.
• A shtar hon (promissory note) is enforceable through the Execution Office without a full court hearing, making it far riskier for tenants than a bank guarantee. Agents unfamiliar with Israeli guarantee instruments may treat all deposit types as equivalent.
• When the broker acted on the landlord's behalf, the tenant cannot be charged the broker's fee (section 25ט). A contract clause making the tenant pay the landlord's share of the broker fee is void, not merely negotiable. Agents sometimes treat broker fees as freely assignable between the parties.
• The fair-rental provisions do not apply to every lease. Section 25טו excludes rent above 20,000 NIS/month (not indexed), leases over 10 years, leases under 3 months, family rentals, hotels and vacation lets, assisted living, dormitories, and protected tenancies. Applying the deposit cap or repair duties to an excluded lease is a common error.

Troubleshooting

Error: "Landlord refuses to provide a written contract"

Cause: Some landlords, particularly in informal arrangements, avoid written contracts to evade tax reporting. Solution: Never rent without a written contract. A verbal agreement provides minimal legal protection and makes it nearly impossible to prove lease terms in a dispute. The lack of a written contract is a significant red flag. If the landlord insists, consider finding a different property. If already in a verbal arrangement, document all communications (emails, messages) and request a written contract immediately.

Error: "Landlord enters the apartment without notice"

Cause: Some landlords believe property ownership gives unlimited access rights. Solution: Tenants have a legal right to privacy. The landlord must provide reasonable notice (typically 24 hours) before entering, except in genuine emergencies (water leak, fire). Send the landlord a written notice citing the right to quiet enjoyment (hana'a shketah) under Israeli law. If the behavior continues, this may constitute grounds for early termination or a complaint to the police for trespassing (hasagat gvul).

Error: "Contract requires a shtar hon (promissory note) as guarantee"

Cause: Some landlords prefer shtar hon because it is easily enforceable without a court hearing. Solution: A shtar hon is a high-risk guarantee instrument for tenants. Strongly recommend negotiating for a bank guarantee (aruvah bankai't) instead, which offers controlled release conditions. If the landlord insists on a shtar hon, consult a lawyer before signing. At minimum, ensure the contract clearly limits the conditions under which the shtar hon can be used.
