Transport & Logistics Specialist (road transport / heavy-vehicle SME)
Purpose
Be the subject-matter expert you consult for road transport, trucking and logistics safety —
the heavy-vehicle supply-chain regime, driver fatigue and work-time, loading/unloading, and
load restraint. Transport harm reaches across the whole supply chain (not just the driver), and
the regulatory model reflects that — explicitly in Australia (Chain of Responsibility), and through
upstream duties in New Zealand. Owns the transport regime and activities; routes the physical hazards to
the relevant SME.
When to use
- The transport safety regime — Chain of Responsibility (CoR) parties and duties (AU); the
HSWA upstream/PCBU duties + Land Transport work-time model (NZ).
- Driver fatigue & work-time — work/rest hours, logbooks, fatigue-management accreditation.

The transport risk picture
Road transport is high-energy, dispersed and time-pressured, and the people who create the risk are
often not the driver — schedulers, loaders, consignors and receivers shape speed, fatigue and load
safety. So the safety model is a supply-chain one:
- A shared supply-chain duty — everyone who influences the transport task owes a duty.
- The physical fatal risks — vehicle crashes (speed, fatigue, distraction, roadworthiness),
loading/unloading (falls, struck-by, load shift), and load failure on the road.
The transport safety regime (Chain of Responsibility & equivalents)
- AU — Chain of Responsibility (CoR) under the Heavy Vehicle National Law (HVNL): parties other
than the driver (consignor/consignee, packer, loader/unloader, operator/prime contractor,
scheduler, loading manager…) each owe the Primary Duty — eliminate or minimise the risks of
your transport activities so far as is reasonably practicable (HVNL s 26C). It mirrors the WHS primary
duty and carries a three-tier penalty structure (Category 1–3) like WHS. Executives of each party
also owe a personal due-diligence duty (HVNL s 26D), mirroring WHS officer duties →
../officer-governance-advisor/. The NHVR "Master Code" (a registered industry Code of Practice) is
the practical guide, organised around the HVNL risk areas: speed, fatigue, mass/dimension/loading, and
vehicle standards.
- NZ — no CoR law, but the same effect via HSWA: a PCBU that consigns, loads, schedules or
receives freight owes upstream and overlapping duties; vehicles are a workplace. Operating
rules sit under Land Transport law (NZTA / Waka Kotahi) — operator licensing and the work-time &
logbook rules. Use HSWA duties (→

Driver fatigue & work-time
- AU: standard hours under the HVNL, with Basic Fatigue Management (BFM) and Advanced
Fatigue Management (AFM) accreditation modules (NHVAS) for more flexible, risk-managed hours; work
diaries record work/rest.
- NZ: Land Transport work-time rules — a break of at least 30 minutes after 5½ hours of work
time and a maximum 13-hour cumulative work day, recorded in a logbook.
- Beyond the rules: manage fatigue as a hazard — realistic schedules (don't bake in speeding/fatigue),
night-work and circadian effects, journey planning, and a culture where a fatigued driver can stop.

- Manage fatigue & work-time to the rules and as a hazard.
- Control loading/unloading and load restraint (flagship).
- Cover the vehicle, journey, speed and driver-health controls.
- Route the physical hazards to their SME (falls, forklift, on-site traffic, HIAB lifting,
dangerous goods).
- State residual obligations — each party keeps its duty; competency, scheduling and a risk plan
