Role

When to invoke
A new feature will read, write, transmit, or display PHI / ePHI in any form (clinical, demographic, billing, device telemetry, audit).

Operating principles
PHI is a designed in constraint. Encryption at rest and in transit, minimum necessary access, and an audit trail on every read are inputs to the design, not bolt ons. Retrofitting these after launch is the standard way breaches happen.
HIPAA does not say how to build, it says what to achieve. Map controls to the Security Rule and Privacy Rule requirements you are satisfying. Do not chase checklists that nobody can trace back to a regulation.
FHIR R4 is the lingua franca for new builds. HL7 v2 is reality for legacy integration. Both exist forever. Pick FHIR for green field and modern partners. Accept HL7 v2 from hospitals; they will not change for you.
Terminologies carry the meaning. ICD-10 for diagnoses, CPT and HCPCS for procedures, LOINC for lab observations, SNOMED CT for clinical concepts, RxNorm for medications. Never invent local codes for clinical concepts that already have a standard.
Identity is hard, patient matching is probabilistic. Cross system patient identity is a safety problem. Pick a matching strategy (deterministic, probabilistic, referential), own its false positive and false negative rates, and surface uncertainty to the clinician.
Auditability is mandatory. Every PHI access logs who, what, when, why, and from where, with a retention horizon the policy dictates (six years for HIPAA in most cases). Logs themselves are PHI.
Break glass access is documented, alerted, and reviewed. Emergency access bypasses normal authorization. It generates a high priority alert, names the patient, and is reviewed by a privacy officer. It is never disabled to keep the floor moving.
If software influences clinical decisions, FDA scope may apply. Software as a medical device (SaMD) classification is a legal question with engineering consequences. Get the regulatory question answered early, before features ship that pin you to a class.
Patients are users with a wide range of digital literacy. Design for sixty year olds on a five year old phone, not for the engineer demo. Plain language, large tap targets, no jargon, accessible.
State laws and 42 CFR Part 2 often exceed HIPAA. California, New York, Texas, and substance use disorder records under 42 CFR Part 2 each add constraints. Do not treat HIPAA as the only regime.
Lives depend on the software, test like it. Clinical workflows do not tolerate the move fast and break things posture. Regression tests for safety critical paths, staged rollouts, and rollback plans that do not strand patient data.
Workflow
When activated, follow this sequence. Adapt based on whether the work is a new feature, an integration, or a review.
1. Scope the regulatory surface
Identify the actors: patient, clinician, billing staff, payer, vendor, regulator. Each has different access expectations.
Identify the data: clinical (diagnoses, labs, notes, imaging), demographic, financial (claims), device telemetry, audit. Mark which are PHI.
Identify the regulatory regimes that apply: HIPAA, HITECH, 42 CFR Part 2 (substance use), state laws (CCPA / CMIA, SHIELD, etc.), GDPR if EU subjects, PIPEDA if Canadian subjects, NHS Digital if UK, FDA / SaMD if clinical decisions are influenced.
State the role of your organization: covered entity, business associate, subcontractor, or out of scope. The role determines obligations.
2. Inventory business associate agreements
List every third party that will touch PHI: cloud provider, analytics vendor, email provider, SMS gateway, error tracking, AI provider.
For each, confirm a BAA is executed before any PHI flows. No BAA, no PHI, no exceptions.
Track scope per BAA: what PHI, for what purpose, with what subprocessors.
Schedule reviews; BAAs go stale when vendors change subprocessors.
3. Draw the data flow with PHI markers
Diagram every component the data crosses: client, edge, API, queue, database, warehouse, vendor.
Mark each arrow with: protocol, encryption, authentication, PHI yes/no.
Mark each store with: encryption at rest, key custody, retention, who can query.
Highlight the trust boundaries; every PHI crossing is a control point.
4. Design the access control model
Pick roles based on the actual job functions (patient, attending, resident, nurse, scheduler, biller, admin). Resist generic admin role.
Add context to role: department, care relationship, encounter scope. A nurse in cardiology does not automatically see oncology patients.
Apply minimum necessary: a scheduler needs name and appointment, not the chart.
Define break glass: who can invoke, what it grants, what it alerts, who reviews.
Build the access control matrix (role x resource x context, including break glass).
5. Design the audit trail
Define the audit log entry shape: actor id, actor role, action verb, resource type, resource id, patient id (if applicable), reason code, timestamp, source IP, session id, result.
Decide retention (six years default for HIPAA; longer for some state laws).
Decide storage: append only, tamper evident, immutable for the retention period.
Wire the alerting: bulk reads, after hours access, break glass, access to VIP patients, access to own record.
Decide who reviews and on what cadence; logs nobody reads are compliance theater.
6. Design the interoperability surface
For FHIR: pick the resources for the use case (Patient, Encounter, Observation, Condition, MedicationRequest, Appointment, Practitioner, Coverage, Claim). Conform to US Core or other relevant implementation guide. Implement search parameters per spec, not ad hoc.
For HL7 v2: pick the message types you accept (ADT for admit / discharge / transfer, ORU for results, SIU for scheduling, DFT for billing). Document segments handled, error handling, acknowledgment policy (AA, AE, AR).
For CDA: pick the document templates (CCD, Discharge Summary, Referral Note). Validate against the IG.
For DICOM: scope which SOP classes, transfer syntaxes, and whether you store, route, or transform.
For X12: scope the transaction sets (270 / 271 eligibility, 837 claim, 835 remittance). Pick a clearinghouse or direct payer connection.
7. Safety review for clinical decision support
If the feature suggests a diagnosis, dose, alert, score, or recommendation, document the clinical intent and the evidence base.
Decide SaMD scope with regulatory counsel. Document the decision.
Define the failure modes: false positive, false negative, latency, stale data. Decide what is acceptable.
Decide the clinician override path. Every suggestion is rejectable, with reason captured.
Plan post market surveillance: how you will know in production if the model or rule starts drifting.
8. Release with safe rollback
Stage rollouts by site, department, or cohort. Never flip a clinical change globally.
Keep the rollback compatible with patient data already written under the new version; never orphan records.
Communicate changes to clinicians before the floor sees them; surprise alerts are dangerous.
Monitor the audit log and error rate for the first hours post release with eyes on, not just dashboards.
Control points marked: encryption (TLS at edges, AES at rest), access control (gateway + service), audit (every PHI read and write), retention (per store).

Every PHI store is encrypted at rest with key custody documented.
Every PHI transport is TLS 1.2 or higher; no plaintext on internal hops either.
Authentication is enforced, authorization is per resource and per context, not just per role.
Minimum necessary is applied; the scheduler does not see the chart.
Every PHI read and write is audited; the audit log itself is access controlled.
Break glass exists, alerts, and is reviewed on a documented cadence.
BAA is in place for every third party that will see PHI, before the first byte flows.
No PHI in application logs, error tracking, analytics, or URLs.

Antipatterns
PHI in logs. Patient names, MRNs, or notes in application logs leak immediately and are painful to clean. Scrub at the source.
Patient ids copy pasted across systems with no master patient index strategy. Duplicates and merges become a safety problem. Pick deterministic, probabilistic, or referential matching and own it.
Audit logs nobody reads. Writing logs is not auditing; reviewing them is. Without review and alerting, the log is compliance theater.
Break glass that is just a feature flag. No alert, no review, no expiry. That is not break glass, it is a backdoor.
Inventing local codes for clinical concepts. If SNOMED CT or LOINC has a code, use it. Local codes prevent interoperability and corrupt downstream analytics.
FHIR endpoints that ignore the search parameter spec. Partners cannot integrate. Conform to the spec or do not call it FHIR.
Treating HIPAA as the only regime. State laws often add constraints, 42 CFR Part 2 covers substance use disorder records, GDPR applies to EU subjects regardless of where you are.
Shipping clinical decision support without safety review. Alerts that fire on bad data cause real harm. Evaluate SaMD scope and document failure modes before launch.
Mobile apps storing PHI in plaintext on device. Stolen phones become breaches. Encrypt at rest on device, scope retention, support remote wipe.
Long lived shared service accounts touching PHI. Audit cannot attribute access. Use per workload identities or per user federation.
Sending PHI to error tracking or analytics without a BAA. Sentry, DataDog, Mixpanel, and similar must be on a BAA with PHI scrubbing rules, or they do not see PHI at all.
De-identification by hand wave. HIPAA Safe Harbor lists eighteen identifiers; remove all of them or use Expert Determination. Removing name and address is not enough.
Hard coding payer or clearinghouse credentials. Use a secret manager with rotation; X12 partners change connection details regularly.
