Research on AI in government procurement (ACM FAccT 2025) documents a structural conflict-of-interest that existing procurement-integrity frameworks were not designed to address: vendors systematically learn from government use of AI tools, gaining insight into agency demand signals and evaluation preferences. When a city uses an AI tool to evaluate bids, the company providing that AI tool may have commercial relationships with one or more bidders — relationships that may not be visible to the procurement officer.
When AI tools are used in bid evaluation, the following requirements apply:
- Conflict check before evaluation begins: confirm that the AI tool vendor has no commercial relationship — including subcontracting, reseller, referral, or investment relationships — with any bidder in the current solicitation. Document the check and the result in the procurement file. If a conflict exists or cannot be ruled out, evaluate using non-AI methods or a different tool, and document the decision.
- Human sign-off is mandatory: AI-generated evaluation scores, rankings, or recommendation summaries are drafts only. A human procurement officer must independently review, adjust as warranted, and sign the final scoring record. The signed human record — not the AI output — is the official evaluation document.
- Public record documentation: the procurement file must include, as a matter of public record: (1) the name and version of any AI tool used in evaluation, (2) the criteria and weights applied in the AI evaluation, and (3) a notation that AI output was reviewed by a named human officer before finalization. A procurement file that contains only AI-generated output is incomplete and potentially indefensible on protest.
