Footnotes, Not In-Text Citations
Legal scholarship uses footnotes exclusively — never parenthetical in-text citations. This is non-negotiable in law review publishing.
- Every factual claim, legal proposition, and quotation gets a footnote.

Order of signals within a footnote follows the Bluebook's prescribed sequence. Authorities within each signal are ordered by weight (constitutions, then statutes, then cases by court hierarchy, then secondary sources).
Research Methodology
Doctrinal / Black-Letter Analysis
The foundational method of legal scholarship:
- Identify the legal question — Frame the issue precisely (e.g., "Does the Fourth Amendment require a warrant for cell-site location information?").
- Collect primary sources — Statutes, constitutional provisions, regulations, case law (binding and persuasive authority).
- Synthesize the rule — Extract holdings, reconcile conflicting authorities, identify majority/minority rules, note circuit splits or inter-jurisdictional variation.

Comparative Legal Analysis
The functional method (Zweigert & Kotz) dominates:
- Identify the social problem — Start with the problem, not the legal rule (e.g., "How do legal systems protect consumers from defective products?").
- Survey jurisdictions — Examine how different legal systems address the same problem. Include at least one common-law and one civil-law jurisdiction.
- Map functional equivalents — Identify different legal mechanisms that serve the same function (e.g., tort liability vs. regulatory standards vs. consumer protection statutes).
- Analyze convergence and divergence — Explain why systems differ (legal tradition, political economy, cultural values, path dependence).

Beware of the comparatist's trap: Avoid superficial comparison that ignores the systemic context in which legal rules operate. A rule that works in Germany's civil-law infrastructure may fail in the U.S. common-law system.

- Purposivism — Interpret statutes in light of their purpose. Consult legislative history, committee reports, sponsor statements.
- Legislative history — Committee reports, floor statements, hearing testimony. Contested in value (compare Breyer's defense with Scalia's critique).
