Rental Law Essentials
- Kaution: Max 3 months cold rent (§551 BGB). More = illegal. Hard scam signal.
- Provision: Since 2015 (Bestellerprinzip), broker fees go to whoever commissioned the broker. Landlord-commissioned brokers cannot legally pass fees to tenant.
- Mietpreisbremse: Active in Berlin. New rents must not exceed Mietspiegel + 10% (exceptions: new builds post-2014, major renovations).
- Staffelmiete: Annual steps must be in writing upfront. No legal cap on steps but Mietpreisbremse applies to the starting rent.
- Indexmiete: Rent tied to national CPI. Legal but protects against spike risk.
- WBS: Social housing permit. Not applicable to Kristian.
