Accessibility Compliance

You know that accessibility is enforceable in the US under the ADA and most ecomm sites fail at least 50 WCAG checks; the question is how to prioritize the remediation that matters.
Initial Assessment

4. Apply the WCAG 2.2 AA framework
WCAG 2.2 AA is the operational target. Walk the four principles and identify the highest-impact failures.
5. Identify the litigation risk profile
ADA-style demand letters cluster on specific failure types. Score the brand against them.
6. Choose an audit path
Automated, hybrid, full manual audit, or specialized user testing. Different paths for different brand stages.
Framework: WCAG 2.2 AA — the four principles
WCAG organizes around POUR: Perceivable, Operable, Understandable, Robust. WCAG 2.2 added nine new criteria in 2023 focused on cognitive accessibility and pointer interactions.
Perceivable. Information must be presentable to users in ways they can perceive.
- Text alternatives for images. Alt text on every meaningful image, empty alt for decorative.
- Captions for video. Live transcript for streamed content above AA.
- Color contrast. 4.5:1 for normal text, 3:1 for large text and UI components. The most-failed criterion in ecomm.
- Don't rely on color alone. Errors marked with text + color, not just red.
- Text resize. Site must work at 200% browser zoom without horizontal scroll.
Operable. Users must be able to operate the interface.
- Keyboard access. Every interactive element must work without a mouse. The most-failed criterion in ecomm after color contrast.
- No keyboard trap. Focus must move out of a component, including modals.
- Skip links. "Skip to main content" link for keyboard users.
- Focus visible. The element with keyboard focus must be visually identifiable.
- Touch target size (2.2 new). Targets at least 24x24 CSS pixels.
- Dragging movements (2.2 new). Drag-only interactions must have an alternative.
Understandable. Content and interface must be understandable.
- Language declared. lang="en" on the html element.
- Consistent navigation. Nav items in same order across pages.
- Labels and instructions. Form fields with visible, programmatic labels.
- Error identification and suggestion. Form errors named, with suggested fixes.
Robust. Content must be robust enough for assistive technologies.
- Valid markup. HTML that screen readers can parse.
- Name, role, value. Custom components must expose their state and purpose programmatically.
- Status messages. Cart updates and async UI changes must announce to screen readers via aria-live or equivalent.
The most-failed criteria in ecomm: color contrast, keyboard access, form labels, focus visible, name-role-value on custom components. Start the remediation there.
Framework: ADA litigation risk profile
US ecomm accessibility lawsuits are at all-time high volume. Plaintiff firms cluster on specific failure patterns.
Risk factors that increase exposure.
- US revenue above $10M and growing brand visibility.
- New York, California, Florida state — heavier plaintiff-firm activity.
- Industry verticals with active enforcement: apparel, beauty, food and beverage, retail multi-brand.
- Visible product launches or PR that increases brand attention.
- Past demand letters not resolved with a public accessibility statement.
Typical demand letter pattern.
- Plaintiff alleges they could not complete a purchase using assistive technology.
- Cites WCAG criteria the site fails (usually 6-12 specific failures).
- Demands remediation, attorney fees, sometimes statutory damages depending on state.
- Settlement range: $20-100k for a single demand letter; $200k-$2M for class-action threat.
Defensive posture.
- Publish a current accessibility statement linking to a recent audit.
- Have a remediation roadmap with dated milestones.
- Provide a contact method for accessibility issues.
- Demonstrate good-faith ongoing work.
The absence of an accessibility statement plus a long list of WCAG failures is the litigation trifecta. Brands with no statement, no audit, and obvious failures are the lowest-hanging fruit for plaintiff firms.
The international parallel: AODA in Ontario, EAA in EU (enforced as of 2025), Equality Act in UK, AccesibilityAct in some other jurisdictions. The trend is global.
Framework: audit options
Four audit paths with different cost, depth, and credibility profiles.
Automated scan (axe DevTools, WAVE, Lighthouse). $0-200/month for tooling. Catches 25-40% of WCAG violations. Strong on structural issues (missing alts, invalid markup, color contrast); blind to interactive failures and screen-reader behavior. Right for: continuous CI integration. Wrong for: claiming WCAG conformance.
Hybrid audit (automated + sampled manual). $5-15k. Vendor or contractor runs automated scan then manual-tests sampled pages with assistive technology. Catches 60-80% of WCAG violations. Right for: brands wanting credible audit without full manual review.
Full manual audit by VPAT-experienced firm. $15-40k for a typical ecomm catalog. Vendor evaluates every template type and key flow with screen readers, keyboard navigation, magnification. Produces a VPAT (Voluntary Product Accessibility Template) usable in procurement. Right for: brands above $25M revenue or facing litigation pressure.
User testing with disabled testers. $5-20k engagement. Real users with various disabilities navigate the site and report friction. Catches issues that conformance audits miss (cognitive load, naming convention confusion, real-world flow breaks). Right for: high-revenue brands or brands with significant assistive-technology user base. Should complement, not replace, conformance audit.
Overlay vendors (accessibility widgets). Recommend against. AccessiBe, UserWay, and similar tools claim to fix accessibility with a JavaScript widget. The plaintiff bar has specifically targeted overlay-using sites; courts have ruled overlays do not create ADA compliance. The widget creates an audit trail that ironically increases liability while not fixing the underlying failures.
The progression for most brands: automated scan in CI immediately, hybrid audit at year one, full audit at year two as revenue scales.
Framework: screen reader testing
The single most consequential skill the team can develop in-house. Free tooling, high signal.
Tools.
- NVDA (Windows, free). The de facto plaintiff testing tool. Test on Firefox first.
- VoiceOver (Mac, iOS, built-in). Test on Safari.
- JAWS (Windows, paid). Enterprise screen reader; test if catalog serves enterprise procurement.
- TalkBack (Android, built-in).
Test cadence.
- Critical flows tested before every release: PDP, cart, checkout, account.
- Top 10 templates tested quarterly.
- New features tested before launch.
Test protocol.
- Navigate by tab only. No mouse.
- Listen to every announcement; the screen reader should describe each element's role, name, value, and state.
- Complete a purchase flow end to end.
- Note any place where the announcement is wrong, missing, or confusing.
Common findings.
- Modals that do not trap focus.
- Add-to-cart buttons that do not announce success.
- Form errors that are visually marked but not screen-reader announced.
- Custom dropdowns that read as nonsense to NVDA.
