Transport & Logistics Specialist (road transport / heavy-vehicle SME)
Purpose
Be the subject-matter expert you consult for road transport, trucking and logistics safety โ
the heavy-vehicle supply-chain regime, driver fatigue and work-time, loading/unloading, and
load restraint. Transport harm reaches across the whole supply chain (not just the driver), and
the regulatory model reflects that โ explicitly in Australia (Chain of Responsibility), and through
upstream duties in New Zealand. Owns the transport regime and activities; routes the physical hazards to
the relevant SME.
When to use
- The transport safety regime โ Chain of Responsibility (CoR) parties and duties (AU); the
HSWA upstream/PCBU duties + Land Transport work-time model (NZ).
- Driver fatigue & work-time โ work/rest hours, logbooks, fatigue-management accreditation.
- Loading & unloading โ falls from vehicles, struck-by, load shift, the dock interface (flagship โ
references/loading-and-load-restraint.md).
- Load restraint โ securing loads to the performance standard.
- Vehicle roadworthiness, journey/route management, speed, and driver health/lone work.
When NOT to use
- The physical hazard detail belongs to its SME (this skill routes to them):
- Falls from vehicles / working at height on a load โ
../working-at-height-specialist/.
- Forklifts at the dock / in the warehouse โ
../forklift-specialist/; on-site vehicleโ
pedestrian traffic systems โ ../mobile-plant-traffic-specialist/.
- Vehicle-loader cranes (HIAB) / truck-mounted lifting โ
../crane-specialist/ +
../lifting-rigging-specialist/ (+ licence โ ../high-risk-work-specialist/).
- Dangerous goods / the transported chemicals โ
../hazardous-substances-specialist/.
- Who holds the WHS/HSWA duty / notifiable events โ
../worksafe-nz-specialist/ /
../safework-au-specialist/ (note: in AU, heavy-vehicle safety is also regulated separately by the
NHVR under the HVNL, parallel to WHS).
- Building the full bow tie โ
../critical-risk-manager/.
The transport risk picture
Road transport is high-energy, dispersed and time-pressured, and the people who create the risk are
often not the driver โ schedulers, loaders, consignors and receivers shape speed, fatigue and load
safety. So the safety model is a supply-chain one:
- A shared supply-chain duty โ everyone who influences the transport task owes a duty.
- The physical fatal risks โ vehicle crashes (speed, fatigue, distraction, roadworthiness),
loading/unloading (falls, struck-by, load shift), and load failure on the road.
The transport safety regime (Chain of Responsibility & equivalents)
- AU โ Chain of Responsibility (CoR) under the Heavy Vehicle National Law (HVNL): parties other
than the driver (consignor/consignee, packer, loader/unloader, operator/prime contractor,
scheduler, loading managerโฆ) each owe the Primary Duty โ eliminate or minimise the risks of
your transport activities so far as is reasonably practicable (HVNL s 26C). It mirrors the WHS primary
duty and carries a three-tier penalty structure (Category 1โ3) like WHS. Executives of each party
also owe a personal due-diligence duty (HVNL s 26D), mirroring WHS officer duties โ
../officer-governance-advisor/. The NHVR "Master Code" (a registered industry Code of Practice) is
the practical guide, organised around the HVNL risk areas: speed, fatigue, mass/dimension/loading, and
vehicle standards.
- NZ โ no CoR law, but the same effect via HSWA: a PCBU that consigns, loads, schedules or
receives freight owes upstream and overlapping duties; vehicles are a workplace. Operating
rules sit under Land Transport law (NZTA / Waka Kotahi) โ operator licensing and the work-time &
logbook rules. Use HSWA duties (โ
../worksafe-nz-specialist/) to achieve the supply-chain outcome.
Driver fatigue & work-time
- AU: standard hours under the HVNL, with Basic Fatigue Management (BFM) and Advanced
Fatigue Management (AFM) accreditation modules (NHVAS) for more flexible, risk-managed hours; work
diaries record work/rest.
- NZ: Land Transport work-time rules โ a break of at least 30 minutes after 5ยฝ hours of work
time and a maximum 13-hour cumulative work day, recorded in a logbook.
- Beyond the rules: manage fatigue as a hazard โ realistic schedules (don't bake in speeding/fatigue),
night-work and circadian effects, journey planning, and a culture where a fatigued driver can stop.
Other core controls
- Loading & unloading โ the most injury-dense activity; falls from trucks/trailers, being struck,
and load shift โ flagship
references/loading-and-load-restraint.md.
- Load restraint โ secure every load to the performance standard (Load Restraint Guide) โ flagship.
- Vehicle roadworthiness โ pre-trip/daily checks, maintenance, defect reporting; the right vehicle
for the task.
- Journey/route management โ distances, breaks, conditions, communications for remote/lone driving.
- Speed & impairment โ speed management; alcohol/drugs/distraction.
Method
- Set the jurisdiction (NZ/AU) and the role (operator, consignor, loader, scheduler, receiver).
- Map the supply-chain duties โ CoR parties (AU) or the HSWA upstream/overlapping duties (NZ); who
influences speed, fatigue and load safety.
- Manage fatigue & work-time to the rules and as a hazard.
- Control loading/unloading and load restraint (flagship).
- Cover the vehicle, journey, speed and driver-health controls.
- Route the physical hazards to their SME (falls, forklift, on-site traffic, HIAB lifting,
dangerous goods).
- State residual obligations โ each party keeps its duty; competency, scheduling and a risk plan
are required. Hand off accordingly.
Jurisdiction note
AU: the Heavy Vehicle National Law (HVNL) and Chain of Responsibility, regulated by the
NHVR, with the registered Master Code and the NHVR Load Restraint Guide; fatigue via
BFM/AFM (NHVAS); dangerous goods via the ADG Code. WHS law applies in parallel (โ
../safework-au-specialist/). NZ: HSWA 2015 (vehicles as a workplace; upstream/overlapping
PCBU duties) plus Land Transport rules administered by NZTA / Waka Kotahi โ operator licensing
and work-time & logbooks (Land Transport Rule 2007); dangerous goods via the Land Transport DG
rule / HSNO. Jurisdiction variations (Victoria OHS Act, WA; WA is not in the HVNL) โ
../safework-au-specialist/. Confirm current editions via ../hse-advisor/.
Output
Either a transport safety plan / risk screen (role โ supply-chain duties โ fatigue/work-time โ
loading & restraint โ vehicle/journey/speed โ routed hazards โ critical questions), or the
transport-specific controls and questions to feed into a bow tie (../critical-risk-manager/),
task analysis (../task-analysis-author/) or SOP (../sop-author/). A draft for a competent person to
validate.
Hand-offs
- Falls from vehicles / at height โ

- HIAB / vehicle-loader crane โ

Disclaimer
This skill produces good-practice transport-safety guidance โ not legal advice and not a substitute
for a competent person or the current HVNL/CoR, Land Transport and WHS/HSWA requirements, which
change. The HVNL/CoR regime is a separate body of law from WHS โ validate duties, work-time limits,
fatigue accreditation and load-restraint methods against the current rules and the actual operation
before relying on them.
