Hazmat Incident Reporting Form 5800
Hazmat incidents require both immediate phone notification AND a written incident report. 49 CFR 171.15 and 171.16. Form 5800.1.
Immediate notification (phone) — within 12 hours of an incident
Required if: person killed. Person hospitalized. Damage >$500,000 (to other-than-the-hazmat material). Material released that's selenium, hexafluoride, radioactive. Fire/breakage/spill of radioactive. Spill of marine pollutant ≥119 gal or 882 lb. Estimated continuing danger to life. Call: PHMSA hotline 800-424-8802 (CHEMTREC also acceptable).
Written report (Form 5800.1) — within 30 days
Required for the same incidents above PLUS: any unintentional release of hazmat from a package or transport vehicle. Bulk-package undeclared damage. Hazardous waste discharge.

Filed via PHMSA online portal. Asks for: time + location + carrier info + material description + cause + casualties + property damage + corrective action.
Investigation
PHMSA may follow up. Cooperation required. May result in violation citations + civil penalties.
Common mistakes
Missing the 12-hour phone deadline (carrier assumes it's a small incident). Late Form 5800.1. Incorrect material identification. Underreported damage.
